| Arctic High Court Judgement - Where Are We Now? | 01/06/2005 |
On 27 April 2005, Mr Justice Park delivered his judgement in the Arctic case in which he found in favour of the Inland Revenue. To give the appellant Mr Geoff Jones of Arctic Systems Limited additional time to consider a further and final appeal, Mr Justice Park granted an extended period of six weeks until 8 June 2005 for a further appeal to be lodged.  |

On 8 June 2005 an appeal was lodged against Mr Justice Park's decision in the High Court dated 27 April 2005. This is a brave move by Geoff Jones to continue his fight to challenge the Revenue's opinion that the dividends from his company paid to his wife should be assessed on himself.  |

As it becomes increasingly difficult to defend contractors against IR35 status enquiries, 'Case Law strategy' adopted in some quarters backfires. In Usetech Ltd v Young, it was decided that the status of the worker should be based upon the terms of the 'upper level' contract between the agency and the end client, which the worker had never seen, and over which he had no control.  |

Myth floating around that only 300 (or is it 200?) IR35 enquiries have been taken up by HM Revenue & Customs, out of which only two people have been brought within the scope of IR35. Figures appear to have originated from a Government answer to a question raised in the House of Commons.

| Amicus Wins Working Time Ruling For Offshore Workers | 02/08/2005 |
Offshore union Amicus wins test case ruling that the Working Time Directive should be applied to UK oil employees working offshore. The judgement stated that offshore workers pattern of one week on and one week off cannot be considered as a period of paid annual leave, and that offshore workers should be entitled to a full four weeks annual leave.

| Corporate Killing - New Laws Will Apply Offshore | 04/08/2005 |
Rona Jamieson of Aberdeen Solicitors Paull & Williamsons uncovers a discrepancy between Scottish and English law in the Government's proposed corporate manslaughter Bill. Under the Bill, corporate manslaughter will not be an offence under Scots law, but will apply to the Oil and Gas industry operating in waters around Scotland. This could have serious ramifications for the oil and gas industry.  |
